Terms and Conditions

Welcome to Race Car Swap, a division of Race Car Swap, LLC, a Montana limited liability company (“we,” “us,” “our,” or “Race Car Swap”). These Terms and Conditions (“Terms”) govern your use of the Race Car Swap website (the “Site”) and marketplace platform (collectively, the “Services”).

By accessing or using our Services, you agree to be bound by these Terms. If you do not agree, you may not access or use the Services.

1. Overview of Services

Race Car Swap is a peer-to-peer online marketplace that enables users to buy and sell used race car parts and equipment. We act solely as a platform provider and are not a party to any transaction between buyers and sellers.

2. Account Registration

To access certain features of the Services, you may be required to register for an account. You agree to provide accurate, complete, and current information. You are responsible for maintaining the confidentiality of your account and password and accept responsibility for all activities that occur under your account.

There is no minimum age requirement at this time; however, by using the platform, you represent that you have the capacity to enter into a binding agreement.

3. Seller Fees and Payments

Sellers are charged a platform fee on each completed transaction. We charge the lower of (a) 14.9% + $0.30 of the fee base (with a $4.30 minimum) or (b) $149 + 6% of the fee base.

The fee base is the item price plus buyer-paid shipping and excludes sales tax. The platform fee is deducted from the seller’s proceeds and helps cover payment processing and marketplace operations.

Eligible buyers may see Affirm (Buy Now, Pay Later) at checkout for orders over $250 (availability depends on buyer eligibility and Stripe).

All payments are processed securely through Stripe Connect. Funds are held in escrow until the buyer confirms receipt by clicking Mark as Received. If shipped with a carrier, funds may be auto-released within 72 hours after the carrier shows Delivered if the buyer takes no action. For Local Pickup orders (no carrier/tracking), funds are released when the buyer clicks Mark as Received.

4. Shipping, Local Pickup, and Fulfillment

Sellers are responsible for fulfillment and delivery in one of two ways:

5. Returns and Refunds

We do not facilitate returns or refunds unless the item(s) delivered are in unacceptable condition that was not disclosed by the seller.

Within 72 hours of delivery or local pickup, if you receive item(s) in unacceptable condition that were not disclosed by the seller, please email us with your order number along with pictures showing the undisclosed conditions. If it is determined that the item(s) are in unacceptable condition, we will be in contact with you and the seller to attempt a negotiation for a partial refund by the seller.

If there is no agreement, we may provide a return shipping label to the buyer to return the product(s) to the seller for a full refund (not typically applicable to Local Pickup unless otherwise coordinated).

NOTE: The order becomes nonrefundable within 72 hours of delivery or local pickup, or as soon as the buyer selects “Mark as Received,” whichever comes first. The order also becomes nonrefundable once the item(s) have been used.

6. Platform Role and Disclaimer

Race Car Swap does not own or sell any items listed on the platform. We do not guarantee the quality, safety, authenticity, legality, or delivery of any products. Transactions are solely between the buyer and seller.

We do not conduct background or identity verification of users at this time. You use the platform at your own risk.

7. Payment Disputes and Chargebacks

All payment disputes, including chargebacks, are subject to Stripe’s dispute resolution process. Race Car Swap does not intervene in financial disputes or transaction reversals beyond Stripe’s standard procedures.

8. Prohibited Conduct

Race Car Swap reserves the right to suspend or terminate any user account at its sole discretion.

9. Intellectual Property

All content, branding, and software used in the Services are the property of Race Car Swap, LLC or its licensors. You may not reproduce, distribute, or modify any part of the Services without prior written consent.

10. Limitation of Liability

To the maximum extent permitted by law, Race Car Swap and Race Car Swap, LLC disclaim all liability for any direct, indirect, incidental, or consequential damages arising from:

Our total liability shall not exceed the total amount of fees we received from the transaction in question.

11. Indemnification

You agree to indemnify and hold harmless Race Car Swap, Race Car Swap, LLC, and their affiliates from any claims, damages, losses, or expenses arising from your use of the Services, your violation of these Terms, or your violation of any rights of a third party.

12. Termination

We reserve the right to suspend or terminate your access to the Services at any time, with or without cause or notice, including for any violation of these Terms.

13. Binding Arbitration and Governing Law

These Terms are governed by the laws of the State of Montana, without regard to conflict of law principles.

Any disputes arising from these Terms or your use of the Services shall be resolved through binding arbitration in Montana under the rules of the American Arbitration Association. You waive any right to a jury trial or to participate in a class action.

14. Modifications to Terms

We may update these Terms from time to time. Changes will be posted to this page with the “Effective Date” updated accordingly. Your continued use of the Services after changes are posted constitutes your acceptance of the revised Terms.
